1. About Who Sells Luxury Homes
Who Sells Luxury Homes (“we,” “us,” or “our”) operates WhoSellsLuxuryHomes.com (the “Site”), a referral and matching service that connects prospective luxury real estate buyers with licensed real estate agents. We are not a licensed real estate brokerage, and we do not provide real estate, legal, financial, or investment advice of any kind.
2. Acceptance of Terms
By using the Site or submitting any information through our contact or matching forms, you confirm that you are at least 18 years of age, that you have the legal capacity to enter into a binding agreement, and that you agree to these Terms of Service and our Privacy Policy, which is incorporated here by reference.
3. The Matching Service
What we do. Who Sells Luxury Homes provides a free service that reviews buyer-submitted criteria and connects prospective buyers with one pre-vetted luxury real estate agent appropriate for their target market and price range.
What we do not do. We are not a real estate brokerage. We do not represent buyers or sellers in real estate transactions. We do not negotiate contracts, provide property valuations, or offer any advice regarding the purchase, sale, or financing of real estate. Nothing on this Site constitutes a representation, warranty, or guarantee regarding any real estate agent, property, market condition, or transaction outcome.
No guarantee of results. Submitting a form on this Site does not guarantee that a match will be made or that any specific agent will be available or appropriate for your search. We reserve the right to decline to make an introduction at our discretion.
Agent independence. Agents introduced through our service are independent licensed real estate professionals. They are not employees, contractors, or agents of Who Sells Luxury Homes. We are not responsible for the actions, advice, representations, or omissions of any agent introduced through our service.
One introduction. Our standard practice is to make one agent introduction per submitted request. By submitting a form on this Site, you consent to being contacted by the agent we identify as your match.
4. No Real Estate or Professional Advice
The content on this Site — including market overviews, neighborhood descriptions, buying process information, and FAQ responses — is provided for general informational purposes only. It does not constitute real estate advice, legal advice, financial advice, tax advice, or any other form of professional advice.
Real estate markets change. Information on this Site may not reflect current market conditions, prices, regulations, or laws. Always consult a licensed real estate professional, attorney, or financial advisor before making any real estate decision.
5. User Submissions
When you submit information through any form on the Site, you represent that:

Buyers are encouraged to independently verify an agent’s credentials with the relevant state real estate commission before entering into a representation agreement.
Market information. We do not warrant that any market information, neighborhood description, or real estate content on the Site is current, accurate, or applicable to your specific situation.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Who Sells Luxury Homes, its owners, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, the matching service, or any agent introduction made through the service — including but not limited to lost profits, lost data, or damages resulting from a real estate transaction.
Our total liability to you for any claim arising out of or related to these Terms or your use of the Site shall not exceed one hundred dollars ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Who Sells Luxury Homes and its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys’ fees — arising out of or related to your use of the Site, your submission of information through the Site, your violation of these Terms, or your violation of any third-party rights.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or the Site that cannot be resolved informally shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA), with proceedings conducted in Baton Rouge, Louisiana. Each party waives the right to a jury trial and the right to participate in any class action proceeding.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect intellectual property or confidential information.
13. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. Continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
14. Termination
We reserve the right to suspend or terminate your access to the Site at any time, without notice, for any reason — including if we believe you have violated these Terms or are using the Site in a manner that harms us or others.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Who Sells Luxury Homes regarding your use of the Site and supersede all prior agreements, understandings, or representations relating to the same subject matter.
